These Terms of Service (hereinafter referred to as "these Terms") set forth the terms and conditions of use of the services (hereinafter referred to as "the Service") provided by SUMIKA CREATE PTE. LTD. (hereinafter referred to as "the Company"). All users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1 (Application)

1. These Terms shall apply to all relationships between Users and the Company regarding the use of the Service.
2. The Company may establish rules, etc. (hereinafter referred to as "Individual Regulations") regarding the use of the Service, in addition to these Terms. These Individual Regulations shall form part of these Terms, regardless of their names.
3. If the provisions of these Terms conflict with the provisions of the Individual Regulations mentioned in the preceding paragraph, the provisions of the Individual Regulations shall prevail unless otherwise specified in the Individual Regulations.

Article 2 (Membership Registration)

1. For the Service, membership registration may be required. Users shall apply for membership registration by the method designated by the Company, and the registration shall be completed when the Company approves the application.
2. The Company may refuse to approve an application for membership registration if the applicant falls under any of the following cases. The Company will not disclose the reason for refusing to approve an application for membership registration.
   • When false information is submitted in the application for membership registration
   • When the application is from a person who has violated these Terms in the past
   • When the Company otherwise determines that membership registration is not appropriate

Article 3 (Membership Fee and Payment Method)

1. Users shall pay the usage fees displayed on the Service for the paid portions of the Service by the method designated by the Company.
2. The monthly membership fee is JPY 33,000 (tax included), and payment will be automatically processed through the designated payment method at the time of registration and each subsequent monthly billing date.
3. If paid options are used, additional fees for each option will be incurred.
4. If payment of the membership fee cannot be confirmed, the Company may temporarily suspend or terminate the provision of the Service.
5. Membership fees and other fees may be changed at the discretion of the Company. In the case of fee changes, notice will be given in advance.

Article 4 (Cancellation)

1. Members may cancel their membership at any time by following the cancellation procedure designated by the Company.
2. The cancellation procedure can be performed from the Stripe payment page.
3. Even if membership is canceled, the membership fee for the month of cancellation will not be refunded.
4. If a member wishes to re-register after cancellation, they must go through the membership registration procedure again.

Article 5 (Prohibited Actions)

Users shall not engage in the following actions when using the Service:

Article 6 (Suspension of the Service)

1. The Company may suspend or interrupt the provision of all or part of the Service without prior notice to Users if it determines that any of the following reasons apply:
   • When performing maintenance or updates on the computer system for the Service
   • When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
   • When computers or communication lines stop due to an accident
   • When the Company otherwise determines that it is difficult to provide the Service
2. The Company shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the provision of the Service.

Article 7 (Copyright)

1. Users may only use, post, or edit information such as text, images, and videos on the Service if they own the necessary intellectual property rights, including copyright, or have obtained permission from the necessary rights holders.
2. The copyright of text, images, videos, etc. posted or edited by Users on the Service shall remain with the Users or other existing rights holders. However, the Company shall be deemed to have obtained permission to use the text, images, videos, etc. posted or edited using the Service, and may use them within the necessary scope for improving the Service, enhancing quality, correcting deficiencies, and publicizing the Service.
3. Except as provided in the preceding paragraph, all copyrights and other intellectual property rights related to the Service and all information related to the Service belong to the Company or parties who have licensed their use to the Company, and Users may not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making transmittable), transmit, distribute, publish, use for business, etc. without permission.

Article 8 (Usage Restrictions and Deregistration)

1. The Company may restrict all or part of the use of the Service or delete the User's registration as a User without prior notice if the User falls under any of the following:
   • When the User has violated any provision of these Terms
   • When it is found that there is false information in the registered information
   • When there is a failure to fulfill payment obligations such as membership fees
   • When there is no response to communication from the Company for a certain period
   • When the Company otherwise determines that use of the Service is not appropriate
2. The Company shall not be liable for any damage caused to the User by the Company's actions based on this article.

Article 9 (Disclaimer and Exemption)

1. The Company does not explicitly or implicitly guarantee that there are no defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, rights infringement, etc.) in the Service, whether factual or legal.
2. The Company shall not be liable for any damage caused to Users arising from the Service.
3. The Company shall not be responsible for any transactions, communications, or disputes between Users and other Users or third parties regarding the Service.

Article 10 (Changes to the Service Content)

The Company may change the content of the Service or discontinue providing the Service without notifying Users, and shall not be liable for any damage caused to Users by this.

Article 11 (Changes to the Terms of Service)

The Company may change these Terms at any time without notifying Users when it deems necessary. When a User starts using the Service after changes to these Terms, the User shall be deemed to have agreed to the changed Terms.

Article 12 (Handling of Personal Information)

The Company shall handle personal information obtained through the use of the Service appropriately in accordance with the Company's Privacy Policy.

Article 13 (Notification or Communication)

Notification or communication between Users and the Company shall be made by the method prescribed by the Company. The Company shall deem the currently registered contact information valid unless it receives a notification of change in accordance with the method separately prescribed by the Company, and shall send notification or communication to that contact information, which shall be deemed to have reached the User at the time of transmission.

Article 14 (Prohibition of Assignment of Rights and Obligations)

Users may not transfer their position under the usage contract or rights or obligations based on these Terms to a third party or provide them as security without prior written consent from the Company.

Article 15 (Governing Law and Jurisdiction)

1. The interpretation of these Terms shall be governed by the laws of Singapore.
2. In the event of a dispute concerning the Service, Singapore shall be the exclusive agreed jurisdiction.
